WORKSHOPS SERVICE AGREEMENT

OFFERINGS COVERED BY THIS AGREEMENT
This Agreement governs your participation in any of the following Kaitlin Robinson Kind Mind Method® offerings:
• A La Carte Workshops (Kind Mind, Kindbody, Kindheart, Breaking Up to Waking Up)
• Microdose Deep Rewirings™ (the “Microdose DR”) — a final-sale digital product
• Self-Esteem Starter Kit — a free digital product
Each offering is described in its own section below where terms differ. All other sections of this Agreement apply to all three offerings unless otherwise noted. Each offering is collectively referred to herein as the “Offering.”
By purchasing, enrolling in, or accessing any of the above Offerings, you (“Participant”) agree to the following terms and conditions established by KIND MIND, LLC, a Delaware limited liability company doing business as Kaitlin Robinson’s Kind Mind Method® (“Company,” “we,” “us,” or “our”), founded and operated by Kaitlin Kaplan (professionally known as Kaitlin Robinson), licensed marriage and family therapist and certified clinical hypnotherapist in the State of California.
Please read this Agreement carefully before completing your purchase or accessing any free Offering. By checking the box at checkout, completing payment, or accessing a free Offering, you confirm that you have read, understood, and agreed to all terms herein.
1. OFFERING OVERVIEWS
A. A La Carte Workshops
Workshops include access to digital lessons, guided meditations, and educational tools designed to support self-awareness, nervous system regulation, and personal development, delivered via the Kajabi platform.
• Access Duration: 90 days (3 months) from date of purchase, unless otherwise stated at checkout.
• Exception: Breaking Up to Waking Up (“BuWu”) includes 180 days (6 months) of access.
• Access periods are non-extendable except at the sole discretion of the Company.
B. Microdose Deep Rewirings™
The Microdose Deep Rewirings™ (“Microdose DR”) is a curated digital bundle of five (5) selected guided meditations designed to support nervous system regulation and personal development. It is delivered via the Kajabi platform.
• Access Duration: Lifetime access to the 5 selected meditations included at time of purchase.
• “Lifetime access” refers to the life of the product as determined by the Company, not the Participant’s lifetime. The Company reserves the right to retire, update, or phase out this offering at any time.
• The Microdose DR does not include the full Emergency Tool Box, Masterclass features, or access to any other Kind Mind® Offering.
• All Microdose DR purchases are final sale. No refunds are available under any circumstances.
C. Self-Esteem Starter Kit (Free)
The Self-Esteem Starter Kit is a complimentary digital resource offered at no charge. By accessing this free Offering, you agree to the terms of this Agreement in full, including all disclaimers, intellectual property protections, limitation of liability, and indemnification clauses. No purchase is required, but access constitutes acceptance of these terms.
• Access Duration: Lifetime access, subject to the Company’s right to retire or update the resource at any time.
• This free Offering does not create any obligation on the part of the Company to provide ongoing access, updates, or support.
2. NOT A SUBSTITUTE FOR THERAPY OR MEDICAL CARE
No Offering covered by this Agreement constitutes psychotherapy, medical care, or mental health treatment of any kind. While Kaitlin Kaplan is a licensed marriage and family therapist and certified clinical hypnotherapist in the State of California, the Company operates solely as an educational and personal development platform. Enrollment in or access to any Offering does not create a therapist–client, provider–patient, or any other professional relationship between you and Kaitlin Kaplan or the Company.
No diagnosis, individualized treatment, or crisis support is provided through any Offering. If you are in crisis or experiencing acute mental health symptoms, please seek support from a licensed healthcare provider or call emergency services immediately.
3. ELIGIBILITY, AGE, AND PAYMENT AUTHORIZATION
You must be at least 18 years of age to access any Offering. If you are under 18, you must have the express legal and financial consent of a parent or legal guardian to participate and, where applicable, to use their payment method. By completing your purchase or accessing a free Offering, you affirm that:
• You are 18 years of age or older; OR
• You are under 18 and have received the legal and financial consent of a parent or legal guardian to access this Offering and, where applicable, complete the purchase using their payment method.
The Company reserves the right to deny access or terminate accounts without refund if this eligibility requirement has not been met.
4. ASSUMPTION OF RISK
You understand that engaging with any Offering — including but not limited to somatic exercises, guided hypnotherapy, EMDR-informed practices, breathwork, nervous system work, and other self-exploratory content — involves personal self-exploration and may bring up emotional, physical, or psychological responses. By accessing or enrolling in any Offering, you voluntarily and knowingly assume all risk associated with your participation.
You represent that you have independently assessed your own capacity and readiness to engage with such content, and you agree to seek appropriate licensed professional support if needed. The Company, Kaitlin Kaplan individually, and all associated parties are not responsible for any emotional, physical, or psychological responses that arise during or after your participation.
5. REFUND AND CANCELLATION POLICY
Refund and cancellation terms for each Offering are governed by the Kind Mind Refund and Cancellation Policy, available at www.kindmind.me/refund-policy and incorporated herein by reference. Please review that policy carefully before completing your purchase.
For ease of reference, key terms are summarized below. In the event of any conflict, the full Refund and Cancellation Policy governs.
• A La Carte Workshops: 5-day refund window from date of purchase. Upgrade credit toward Masterclass available within 5 days of purchase.
• Microdose Deep Rewirings™: Final sale. No refunds under any circumstances.
• Self-Esteem Starter Kit: Free. No purchase or refund applicable.
6. COMMUNITY GUIDELINES
If any Offering includes community features such as comments, reflection prompts, or office hours, you agree to engage respectfully and maintain emotional safety for all participants. Harassment, hate speech, self-promotion, or abusive behavior of any kind may result in immediate removal from the Offering without refund.
7. ACCESS AND PLATFORM LIMITATIONS
Paid Offering content is hosted on Kajabi and may be temporarily interrupted for routine maintenance, technical updates, or platform changes. You are responsible for maintaining your login credentials and for accessing content via a desktop browser if mobile access is disrupted. No refunds will be issued for temporary outages or user-side technical issues. For uninterrupted access, the desktop browser version is recommended.
The Company reserves the right to update, modify, or remove content, features, or bonuses within any Offering at any time. These changes do not entitle Participants to refunds, credits, or cancellations.
8. INTELLECTUAL PROPERTY
All materials associated with any Offering — including lessons, guided meditations, audio recordings, worksheets, branding, frameworks, and written content — are the exclusive intellectual property of KIND MIND, LLC and Kaitlin Kaplan. Proprietary terminology including Kind Mind Method®, Deep Rewiring™, and Soul Print™ are trademarks of KIND MIND, LLC.
You may not reproduce, share, distribute, sublicense, or sell any part of any Offering or its materials without express prior written permission from the Company. This applies equally to free Offerings. Unauthorized use may result in immediate termination of access and may subject you to legal action.
9. TRADEMARKS AND BRAND NAMES
"Kaitlin Robinson’s Kind Mind Method®," "Kind Mind Method®," "Kind Mind™," "Deep Rewiring™," "Soul Print™," and all associated names, logos, taglines, and variations (collectively, the “Marks”) are the proprietary trademarks of KIND MIND, LLC. You agree not to use, reproduce, or represent these Marks in any way that implies affiliation, endorsement, or ownership without prior written consent from the Company.
10. NO GUARANTEES
Individual results vary. No specific outcomes are guaranteed. Personal transformation is a nonlinear process that depends on your own participation, readiness, and circumstances. Any testimonials featured in any Offering reflect personal experiences only and are not guarantees of specific results. Use of Kind Mind Method® tools and materials is voluntary and at your sole discretion and risk.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KIND MIND, LLC, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AFFILIATES, AND SUCCESSORS — INCLUDING KAITLIN KAPLAN INDIVIDUALLY (ALSO KNOWN AS AND PROFESSIONALLY OPERATING AS KAITLIN ROBINSON), AND HER SPOUSE, FAMILY MEMBERS, HEIRS, ESTATE, AND LEGAL REPRESENTATIVES — SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ENROLLMENT IN OR USE OF ANY OFFERING COVERED BY THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF ANY OF THE ABOVE-NAMED PARTIES TO YOU EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC OFFERING GIVING RISE TO THE CLAIM. FOR FREE OFFERINGS, TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless KIND MIND, LLC, and its members, managers, officers, employees, agents, contractors, licensors, affiliates, and successors — including Kaitlin Kaplan individually (also known as and professionally operating as Kaitlin Robinson), and her spouse, Neil Kaplan, family members, heirs, estate, and legal representatives — from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your enrollment in or use of any Offering; (b) your violation of this Agreement; (c) your violation of any applicable law, regulation, or third-party right; or (d) any misrepresentation made by you.
13. GOVERNING LAW AND JURISDICTION
This Agreement is entered into by a Delaware limited liability company operating in the State of California. Accordingly:
• Matters relating to the formation, structure, and governance of KIND MIND, LLC as a corporate entity shall be governed by the laws of the State of Delaware.
• Matters relating to the performance of this Agreement, consumer rights, and any dispute arising from Participant’s use of any Offering shall be governed by the laws of the State of California, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Barbara County, California. By enrolling in or accessing any Offering, you hereby consent to personal jurisdiction in such courts and waive any objection to venue. [ATTORNEY: Please confirm dual-state clause and preferred dispute resolution mechanism.]
14. CLASS ACTION WAIVER
To the fullest extent permitted by applicable law, you agree that any claim or dispute arising out of or related to this Agreement or any Offering shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You expressly waive any right to bring or participate in any class action lawsuit, class-wide arbitration, or any other consolidated or representative proceeding.
15. TAXES
Sales tax or VAT may apply depending on your state or country of residence. You are solely responsible for any applicable taxes arising from your purchase of any paid Offering.
16. SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. NO WAIVER
Failure by the Company or any of the above-named parties to enforce any provision of this Agreement on any occasion shall not constitute a waiver of that provision or any other. All rights and remedies are cumulative and not exclusive of any other rights or remedies provided by law.
18. ENTIRE AGREEMENT
This Agreement, together with the Kind Mind Disclaimer and Limitation of Liability and the Kind Mind Refund and Cancellation Policy, each posted at www.kindmind.me, constitutes the entire agreement between you and the Company with respect to the Offerings covered herein and supersedes all prior or contemporaneous understandings, representations, or agreements, whether written or oral.
19. ACCEPTANCE
By checking the box at checkout and completing your purchase, or by accessing any free Offering, you confirm that you have read, understood, and agreed to this Service Agreement in full, including all eligibility requirements, refund policy, intellectual property protections, and legal disclosures.
For paid Workshops: You acknowledge that enrollment constitutes a binding purchase agreement for the full access period (90 days, or 180 days for Breaking Up to Waking Up), and that no early cancellations, pauses, or partial refunds are permitted beyond the stated refund window.
For the Microdose Deep Rewirings™: You acknowledge that this is a final-sale purchase and no refunds are available under any circumstances.
For the Self-Esteem Starter Kit: You acknowledge that by accessing this free resource, you are agreeing to the terms of this Agreement in full.
